    What is a seasonal LMIA in Canada?

    A seasonal LMIA is a Labour Market Impact Assessment that employers use to hire temporary foreign workers for short-term, recurring roles during peak seasons (common in industries such as agriculture, hospitality, landscaping, and construction). Employers must demonstrate a genuine seasonal need and run a documented recruitment process showing that no qualified Canadians were available. Service Canada then assesses the application and, if approved, issues a positive LMIA that lets the worker apply for a work permit tied to that employer and position.

    How long does the seasonal LMIA process take?

    The seasonal LMIA process typically takes between 1–4 months for Service Canada to review and issue a decision. When you factor in time for recruitment, document gathering, and preparing the application, the overall timeline is usually 3–6 months from start to finish.

    What are the requirements for the Seasonal Agricultural Worker Program (SAWP)?

    The Seasonal Agricultural Worker Program lets Canadian employers hire temporary foreign workers (TFWs) when Canadians or permanent residents aren’t available. Under SAWP, employers may hire temporary workers from Mexico or participating Caribbean countries for up to 8 months (between January 1 and December 15), provided the job offers at least 240 hours of work within a 6-week period. To qualify, the work must be in on-farm, primary agricultural production within specific commodity sectors, and the workers must be experienced in farming, at least 18 years old, citizens of a participating country, and eligible under both Canadian immigration law and the laws of their home country.

    Who is responsible for paying the seasonal LMIA fees?

    The Canadian employer must pay the application fee for a seasonal worker's LMIA. It is unlawful to charge this cost to the temporary foreign worker.

    Yes, in most cases, a Labour Market Impact Assessment is required for seasonal workers in Canada. The LMIA is a document issued by Employment and Social Development Canada (ESDC) that enables employers to hire temporary foreign workers when qualified Canadians or permanent residents are unavailable.

    For seasonal roles, such as in agriculture, tourism, hospitality, or certain construction positions, the LMIA ensures that hiring a foreign worker will not negatively impact the Canadian labour market.
